  1. DEFINITIONS

The term 'Company' shall mean 'AMROS COMMERCIAL PRIVATE LIMITED' a private limited company limited by shares and registered under the Companies Act, 2013 and having its registered office at 15, JADUNATH SARKAR ROAD, LAKE TERRACE, 3RD FLOOR, Kolkata WB 700029 IN. The Company is an RBI registered NBFC.
    2. Activities including digital lending are undertaken via the App 'Loanbaba – Personal loan App' (henceforth referred as App), this app may be used by other NBFCs as well and the App, and other activities including promotional activities may be undertaken via the App in the future.
    3. The term 'You', 'Your' & 'User' shall mean any legal person or entity accessing or using the services provided on this Website, who is competent to enter into binding contracts, as per the provisions of the Indian Contract Act, 1872.
    4. The terms 'We', 'Us' & 'Our' shall mean the website/domain/Loanbaba/or AMROS and the Company (collectively referred to as the "Platform"), as the context so requires. This Policy will be applicable to the Company to the extent applicable under the IT (RSP) Rules and the DLG Guidelines to the extent applicable.
  2. INFORMATION WE COLLECT

    We may collect and process the following categories of personal information:

    1. Identity information: Name, date of birth, PAN number, Aadhaar number, photograph, and other government-issued identification details.
    2. Contact information: Mobile number, email address, residential address, and communication preferences.
    3. Financial information: Bank account details, salary/income details, employment details, credit history, and bank statements.
    4. Device and usage information: Device identifiers, IP address, browser type, operating system, app usage data, and location information collected through the Loanbaba app or website.
    5. KYC documents: Scanned copies or photographs of identity and address proof documents as required under RBI KYC norms.
  3. HOW WE USE YOUR INFORMATION

    We use the information collected for the following purposes:

    1. To evaluate and process your loan application;
    2. To verify your identity and conduct KYC/AML checks as required by RBI;
    3. To communicate with you regarding your loan account, repayments, and any changes to terms;
    4. To assess your creditworthiness through credit bureaus;
    5. To comply with legal, regulatory, and compliance obligations;
    6. To prevent fraud, money laundering, and other financial crimes;
    7. To improve our products, services, and customer experience;
    8. To send you relevant notifications, alerts, and service communications.
  4. SHARING OF INFORMATION

    We may share your personal information with:

    1. Technology partner: Sahas Technologies Pvt. Ltd. (Loanbaba), our exclusive lending service provider, to facilitate loan processing and disbursal.
    2. Credit bureaus: CIBIL, Experian, CRIF, Equifax, and other credit information companies for credit assessment purposes.
    3. Regulatory authorities: Reserve Bank of India, Financial Intelligence Unit – India (FIU-IND), and other regulatory/law enforcement agencies as required by law.
    4. Legal and professional advisors: For the purpose of legal proceedings, debt recovery, or compliance with court orders.
    5. Service providers: Third-party vendors engaged to provide services such as KYC verification, cloud storage, communication services, and analytics, who are bound by confidentiality obligations.

    We do not sell, rent, or trade your personal information to third parties for their marketing purposes.

  5. DATA SECURITY

    We implement appropriate technical and organizational security measures to protect your personal information against unauthorized access, disclosure, alteration, or destruction. These measures include:

    1. Encryption of sensitive data during transmission and storage;
    2. Access controls and authentication mechanisms to restrict data access to authorized personnel only;
    3. Regular security assessments and audits;
    4. Employee training on data privacy and security practices.

    While we take all reasonable precautions, no method of transmission over the internet or electronic storage is 100% secure.

  6. DATA RETENTION

    We retain your personal information for as long as necessary to fulfil the purposes for which it was collected, including for the purposes of satisfying any legal, regulatory, accounting, or reporting requirements. As per RBI KYC guidelines and PMLA requirements, KYC documents and transaction records are retained for a minimum of five years after the cessation of the business relationship.

    1. The right to access the personal information we hold about you;
    2. The right to request correction of inaccurate or incomplete personal information;
    3. The right to request deletion of your personal information, subject to our legal and regulatory obligations;
    4. The right to withdraw consent, where processing is based on consent, without affecting the lawfulness of processing prior to withdrawal.
